The City has received and reviewed a SEPA checklist for probable adverse environmental impacts associated with the proposed project and expects to issue a Mitigated Determination of Non-Significance (MDNS) for this project.

The lead agency for this proposal has determined that the project does not have a probable adverse impact on the environment, mitigation measures will be covered through the City of Ferndale regulations and review process. This rezone application does not include plans for future development. Development projects in the future will be addresses separately through City regulations and SEPA if applicable. In addition to compliance with current City regulations, the following mitigation measures were identified relative to the proposed project:
TRANSPORTATION:
As identified in the International Traffic Engineers Manual, trip generation is generally less for the range of uses in General Business Zone than comparable sized businesses in the Regional Retail Zone. Traffic trips generated will be reviewed through SEPA and FMC at time of development proposal.
CULTURAL RESOURCES:
Should archaeological materials (e.g. shell midden, faunal remains, stone tools) or human remains be observed during project activities, all work in the immediate vicinity shall stop, and the area shall be secured. The contractor/owner shall contact the state Office of Archaeology and Historic Preservation (OAHP) at 360-586-3065, the Lummi Nation Tribal Historic Preservation Office (LNTHPO) at 360-384-2298, and the Nooksack Tribe at 360-592-9065 in order to help assess the situation and determine how to preserve the resource(s). In the event that the find includes human remains the Ferndale Police Department shall be called immediately at 360-384-3390. Regarding human remains, the LNTHPO will contact the appropriate tribal repatriation specialists. Compliance with all applicable laws pertaining to archaeological resources is required.

The site is zoned Manufacturing and designated as Industrial in the Comprehensive Plan.
PROJECT DESCRIPTION: Whatcom County proposes Phase I and Phase II of the Whatcom County Adult Corrections Facility and Sheriff Headquarters on an undeveloped 39.3 acre site located within the 5000 block of LaBounty Drive. The adult corrections facility is considered an Essential Public Facility and is subject to Ferndale Municipal Code 18.92. The project requires Conditional Use approval by the City of Ferndale Hearing Examiner. The proposed campus will consist of approximately 215,000 square feet of new construction divided into 3 separate buildings. The proposal includes wetland impacts, wetland preservation and wetland mitigation/enhancement, as well as related infrastructure including stormwater detention and treatment. The Ferndale Hearing Examiner will consider the proposed use and development plans at a public hearing. Subsequent development permits (building permits, land disturbance permits) will be submitted in the future in reliance on the requested Conditional Use approval.
ENVIRONMENTAL: Final Environmental Impact Statement was completed on November 8, 2013.
