PROJECT LOCATION: 5475 Ferndale Road. Assessor Tax Parcel # 390230434203. The project site is located within Pioneer Park, immediately south of the Pioneer Park cabins and stage. The site is west of Ferndale Road and the Nooksack River.
PROJECT DESCRIPTION: The City of Ferndale proposes to development Star Park, a 12,000 square foot playground designed by local school children and featuring playground elements for children of various ages and physical abilities. The playground will be built by the Ferndale community in Summer 2016.
REQUESTED ACTION(S):
The applicant requests a SEPA Threshold Determination. A Shoreline Substantial Development permit and Land Disturbance Permit are also required.

The lead agency for this proposal has determined that the project does not have a probable adverse impact on the environment, mitigation measures will be covered through the City of Ferndale regulations and review process.
In addition to compliance with current City regulations, the following mitigation measures were identified relative to the proposed project:
LAND AND SHORELINE USE:
The City has identified this site as a future playground site in comprehensive parks planning documents for over twenty years. The current Parks, Recreation and Trails Master Plan includes Star Park at this location. The City seeks to continue to improve Pioneer Park in order to provide a wide variety of activities and attractions for all ages. These improvements will continue to solidify Pioneer Park as not only Ferndale’s largest park, but as a regional attractions that combines a number of unique uses – making the park an anchor for the City’s urban core.
ENVIRONMENTAL HEALTH:
The City is developing specific volunteer schedules and volunteer needs. Based on these documents, the City will determine the maximum volume of volunteers and will work with City departments to identify ways to mitigate for impacts. These mitigation measures may be distributing the mass of volunteers throughout the day, reducing noise producing equipment to certain times of the day, and more.
WATER:
Where necessary, temporary and permanent erosion control measures will be installed.
CULTURAL RESOURCES:
Should archaeological materials (e.g. shell midden, faunal remains, stone tools) or human remains be observed during project activities, all work in the immediate vicinity shall stop, and the area shall be secured. The contractor/owner shall contact the state Office of Archaeology and Historic Preservation (OAHP) at 360-586-3065, the Lummi Nation Tribal Historic Preservation Office (LNTHPO) at 360-384-2298, and the Nooksack Tribe at 360-592-9065 in order to help assess the situation and determine how to preserve the resource(s). In the event that the find includes human remains the Ferndale Police Department shall be called immediately at 360-384-3390. Regarding human remains, the LNTHPO will contact the appropriate tribal repatriation specialists. Compliance with all applicable laws pertaining to archaeological resources is required.

The City has determined that the construction of the proposed building is likely not to result in adverse impacts to the environment provided that the project complies with all City codes in place at the time of building permit application.
In addition to compliance with current City regulations, the following mitigation measures were identified relative to the proposed project:
EARTH:
An erosion control plan will be implemented to comply with the NPDES construction stormwater permit and guidance. Construction Stormwater Pollution Prevention (SWPPP) will include erosion control BMPs implemented in accordance with the 2005 Department of Ecology (DOE) manual (or latest addition adopted by the City).
Watering during construction to alleviate the impact of dust is required.
AIR:
Contactors will take reasonable precautions to minimize dust emissions. Reasonable precautions may include, but are not limited to, the use of wet suppressants during the dry weather, reducing vehicle speeds, cleaning vehicle undercarriages before exiting to prevent track-out of much or dirt onto paved public roadways, and taking other measures to minimize dust emissions. It is anticipated that equipment used in the construction work will be equipped with factory installed exhaust systems to retard emissions.
WATER:
Applicant will install or preserve measures to comply with the DOE guidelines and the required NPDES permit. The respective reduction of impacts to water runoff and water quality will be mitigated fully in the final design of the site. Best Management Practices (BMPs) will be implemented properly during construction. Applicant will ensure roof drains will be directed to stable splash blocks to maintain the existing drainage pattern on this site.
NOISE:
Noise impacts from construction of this project will be limited in duration. Measures such as the contractor using and regularly maintaining efficient exhaust mufflers and quieting devices on equipment will be expected when required by City of Ferndale ordinances. Construction activities will be restricted to hours between 6AM and 7PM.
TRANSPORTATION:
Traffic control, or haul routes (if applicable) shall be coordinated through the Public Works Department.

PROJECT LOCATION: The project site is located at the on the east site of Malloy Avenue approximately ¼ mile north of Thornton Street, within the 6200 block of Ferndale, WA.
PROJECT DESCRIPTION: The original Malloy Village PUD was approved by the Ferndale City Council on December 13, 2004, and final plat approval was issued for Phases Two and Phase Three of the project on April 13, 2006.
The original Malloy Village Plat Approval expired in December 2014. A new Planned Unit Development Application has been submitted to complete the project. The current proposal is to subdivide a portion of Malloy Village PUD site into 109 single family lots and construct the associated infrastructure (roads, water, sewer and storm) to service the development with provisions for open space, landscaping, lighting, park areas, trails and protected wetland conservation areas and wetland buffers.
The 109 proposed lots consist of 45 new single family lots and 64 new zero lot line units (attached single family dwellings).
