The City of Ferndale has received application(s) from the applicant referenced below for a proposed development project within the city limits. PROJECT DESCRIPTION:
The subject property includes two 0.2-acre parcels. Lot A is developed with a medical office building. Lot B consists of the primary parking for the building. The proposal includes construction of a new 2-unit office building on Lot B. The existing building on Lot A will be demolished and replaced with a parking lot.
Fill and grade activities proposed for the project is approximately 3,300 cubic yards. This exceeds the minimum threshold of 1,000 cubic yards of fill and grade – therefore a SEPA review is required.
The project is located within the FEMA 100-year flood plain – therefore a SEPA review is required.

The lead agency for this proposal has determined that the project does not have a probable adverse impact on the environment, mitigation measures will be covered through the City of Ferndale regulations and review process.
In addition to compliance with current City regulations, the following mitigation measures were identified relative to the proposed project:
EARTH:
During construction, the contractor will install and maintain erosion and sediment control Best Management Practices as needed to control erosion.
A temporary erosion control plan will be designed by a licensed Civil Engineer to meet City and State requirements.
AIR:
Erosion and sediment control best management practices will be used during construction. Equipment will be maintained to limit emissions. Spraying the disturbed soil with water will limit the amount of dust. Spray will be limited to reduce runoff. Unnecessary idling will be reduced.
WATER:
Surface water impacts during construction will be minimized through the enforcement of temporary erosion and sedimentation control measures outlined in the Spill Prevention, Control, and Countermeasure (SPCC) Plan until the site is fully stabilized.
Stormwater management review and approval by the City is required when any proposed development or redevelopment meets or exceeds the threshold conditions defined in the Department of Ecology’s 2005 Stormwater Management Manual for Western Washington (Manual) (FMC 13.34.040).
Note, currently the City requires compliance with the 2005 Ecology Manual. All applications submitted on or after January 1, 2017 must comply with 2014 Stormwater Management Manual for Western Washington All projects approved prior to January 1, 2017 which have not started construction by January 1, 2022 must comply with the 2014 Stormwater Management Manual for Western Washington
The subject property is located within the 100-Year Floodplain of the Nooksack River, and shall comply with Federal Emergency Management Agency (FEMA) requirements, as well as City requirements as per Ferndale Municipal Code 15.24 (Floodplain Management). Compliance shall include raising the lowest habitable floor above Base Flood Elevation, and demonstrating that the flood attenuation capacity of the floodplain is not reduced as a result of development.
The applicant shall establish a flood control plan that will facilitate the rapid removal of construction materials from the site, should a flood event occur which would inundate the site.
NOISE:
Working hours are limited to 7AM-10PM. Contractor to monitor activities and respond to noise in a timely manner, and utilize modern equipment with noise suppression.
PUBLIC SERVICES:
No impacts or equipment storage on Main Street is allowed during construction. The applicant shall submit a flagging plan and/or additional information Public Works for review and approval for other roads that could be impacted during construction.
PLANTS:
The undeveloped parts of the site will be landscaped using native and non-native plants. Landscaping shall provide food and cover for wildlife.
AESTHETICS:
The building design will conform to the City of Ferndale Design Review Standards for the Mixed Use Commercial zoning district established in Chapter 18.45 of the City of Ferndale Municipal Code. Lighting fixtures will have cutoff lenses to limit spillover light on adjacent properties, the use of LED lights or similar is encouraged.
CULTURAL RESOURCES:
Should archaeological materials (e.g. shell midden, faunal remains, stone tools) or human remains be observed during project activities, all work in the immediate vicinity shall stop, and the area shall be secured.  The contractor/owner shall contact the state Department of Archaeology and Historic Preservation (DAHP) at 360-586-3065, the Lummi Nation Tribal Historic Preservation Office (LNTHPO) at Lena Tso, THPO 360-312-2257; Tamela Smart, Deputy THPO 360-312-2253 in order to help assess the situation and determine how to preserve the resource(s).  In the event that the find includes human remains the Ferndale Police Department shall be called immediately at 360-384-3390.  Regarding ancient human remains, the LNTHPO will contact the appropriate tribal repatriation specialists.  Compliance with all applicable laws pertaining to archaeological resources is required.

No action commenced by the Beneficiary of the Deed of Trust is now pending to seek satisfaction of the obligation in any Court by reason of the Borrower’s or Grantor’s default on the obligation secured by the Deed of Trust/Mortgage.

The default(s) for which this foreclosure is made is/are as follows: Failure to pay when due the following amounts which are now in arrears: $5,050.01
IV.
The sum owing on the obligation secured by the Deed of Trust is: The principal sum of $629,512.13 , together with interest as provided in the Note from 10/1/2015 on, and such other costs and fees as are provided by statute.
V.
The above-described real property will be sold to satisfy the expense of sale and the obligation secured by the Deed of Trust as provided by statute. Said sale will be made without warranty, expressed or implied, regarding title, possession or encumbrances on 10/28/2016 . The defaults referred to in Paragraph III must be cured by 10/17/2016 (11 days before the sale date) to cause a discontinuance of the sale.
