PROJECT DESCRIPTION: The City proposes the adoption of a new chapter to the Ferndale Municipal Code to be titled Non-Retail Development Standards, codified as Ferndale Municipal Code 18.59. Amendments to FMC 18.45, 18.49, 18.50, 18.51 and 18.54 (the zones listed above) are also proposed.
The new chapter would establish flexible design guidelines for non-retail development with certain zones, generally those zones that allow or encourage a mix of land uses. As proposed, applicants will be required to demonstrate to the City that design elements have been used in the architectural and site design, complying with one of four model approaches, or an alternative design approach of the applicant’s choosing. An emphasis has been placed on facades facing rights-of-way.
REQUESTED ACTION(S):
The City of Ferndale requests approval of an amendment to the Ferndale Municipal Code and Official Zoning Map.

PROJECT DESCRIPTION: As part of required updates to the City’s Comprehensive Plan, the City of Ferndale will make a recommendation to Whatcom County related to future land uses requirements and UGA boundaries necessary to serve growth forecasts over the next twenty years (to 2036).
City staff recommends the transfer of approximately 120 acres at the northeast intersection of Pacific Highway and Slater Road from UGA Reserve to UGA, with all other UGA boundaries being preserved in their current configuration.
The City will also make a recommendation to Whatcom County related to overall population and employment allocations for the City of Ferndale.
REQUESTED ACTION(S):
The City of Ferndale requests a recommendation on UGA boundaries as part of the 2016 Comprehensive Plan Process.

The City of Ferndale has received application(s) from the applicant referenced below for a proposed development project within the city limits. Based on review of the materials submitted, the development applications have been determined to be complete. The City has received and reviewed a SEPA checklist for probable adverse environmental impacts associated with the proposed project and expects to issue a Mitigated Determination of Non-Significance (MDNS) for this project.

PROJECT DESCRIPTION: The project consists of stripping the topsoil of an existing pasture, importing fill and re-grading the subject area, then re-spreading the stripped topsoil and re-seeding the area. The existing land use (one single family residence) will not change.
The applicant proposes to cut approximately 1,625 cubic yards (to be re-spread on property), approximately 6,500 cubic yards of fill and import 6,500 cubic yards in addition to the previously approved 499 cubic yards of fill and grade to the project site.
REQUESTED ACTION(S):
The applicant requests approval by the City of Ferndale for a Land Disturbance Permit and a SEPA Determination.

The lead agency for this proposal has determined that the project does not have a probable adverse impact on the environment, mitigation measures will be covered through the City of Ferndale regulations and review process.
In addition to compliance with current City regulations, the following mitigation measures were identified relative to the proposed project:
EARTH:
An erosion control plan will be implemented to comply with the NPDES construction stormwater permit and guidance. Construction Stormwater Pollution Prevention (SWPPP) will include erosion control BMPs implemented in accordance with the 2005 Department of Ecology (DOE) manual (or latest addition adopted by the City).
Watering during construction to alleviate the impact of dust is required.
AIR:
The project will include dust control measure such as applications of water to control dust and construction equipment operation will be limited to daylight hours.
WATER:
Applicant will install or preserve measures to comply with the DOE guidelines and the required NPDES permit.
AESTHETICS:
The site, in its finished condition, will match the existing pasture.
NOISE:
Construction hours shall be limited to 7AM-7PM.
TRANSPORTATION:
Traffic control, or haul routes (if applicable) shall be coordinated through the Public Works Department.
CULTURAL RESOURCES:
Should archaeological materials (e.g. shell midden, faunal remains, stone tools) or human remains be observed during project activities, all work in the immediate vicinity shall stop, and the area shall be secured. The contractor/owner shall contact the state Office of Archaeology and Historic Preservation (OAHP) at 360-586-3065, the Lummi Nation Tribal Historic Preservation Office (LNTHPO) at 360-384-2298, and the Nooksack Tribe at 360-592-9065 in order to help assess the situation and determine how to preserve the resource(s). In the event that the find includes human remains the Ferndale Police Department shall be called immediately at 360-384-3390. Regarding human remains, the LNTHPO will contact the appropriate tribal repatriation specialists. Compliance with all applicable laws pertaining to archaeological resources is required.
